Terms & Conditions

The Tradecard is issued under strict conditions of use as listed. By signing the Tradecard and using it to obtain access to a MAKRO store, the business which is the Tradecard holder (the”Holder”) and any authorised user agree to be bound by and will observe and perform MAKRO’s conditions of Use from time to time in force. The Holder confirms that the information given to MAKRO at or before the time of signature is accurate. The Holder will notify MAKRO of any changes in writing and a new Tradecard will be issued.

1. The Holder confirms that at all times: a) he/she is actively engaged in the business(es) named and at the address(es) given at the time of registration.
b) The authorised users are directors, nominated managers or proprietors of the Holder.
2. Holders must be bona fide traders or businesses. MAKRO deals with the Holder and only the Holder will be invoiced for goods purchased.
3. Goods for sale are intended for and sold on the condition that they are for re-sale, commercial or industrial use only. Private individuals may not make purchases.
4. MAKRO is a self service wholesale centre for trade use only and the general public is NOT admitted under any circumstances. Entry into MAKRO is permitted only to the authorised buyer named on the Tradecard. The Tradecard must be produced on all occasions for entry into MAKRO. Proof of identification must be given on demand. The Tradecard and rights conferred by it cannot be transferred to any other person and any unauthorised use will invalidate the Tradecard and may result in withdrawal. The rights under which MAKRO trades require your compliance with these terms and conditions, Any breach by the Holder which affects, or threatens to affect the permissions and consents under which MAKRO trades, will render the Holder liable to MAKRO.
5. Loss of a Tradecard must be reported to MAKRO immediately. If the Holder’s business closes down, is sold or disposed of then he/she should notify MAKRO in writing immediately and, in such event the Tradecard will be invalid. Any further use shall render the Holder liable to MAKRO.
6. The Tradecard remains the property of MAKRO at all times.
7. The Tradecard and the rights that accompany it may be withdrawn by MAKRO at any time without any reason being given.
8. The Holder shall comply with and abide by all legal and MAKRO requirements and policies when on MAKRO premises or making purchases at any MAKRO store.
9. Buying and/or parking on MAKRO premises is done entirely at the risk of the Holder, authorised user and any person accompanying them save for liability for personal injury or death arising from MAKRO’s negligence.
10. Makro publications are subject to alterations at any time.
11. If any authorised user (or person accompanying them) opens or damages any original package the Holder shall be bound to buy the whole package concerned at its full price.
12. All purchases can be paid for in cash or by Mastercard/Visa Credit Card (excluding Tobacco products), Switch/Delta Debit Card or by cheques supported by a Bank Guarantee Card. Customers wishing to present cheques of larger amounts than the guarantee limit must make special arrangements with the store, Cash transactions over £9,000 may require proof of identity.
13. By paying the invoiced amount the Holder confirms receipt of the goods. Goods will only be refunded/exchanged if the goods are returned in their original condition in their original packaging and are supported by the relevant invoice. Damages or other mistakes must be notified before the authorised user leaves the premises where reasonably practicable. 14. The Tradecard allows admission to a maximum of two persons at any one time one of whom must be an authorised user.
The other may be any person to assist the authorised user but he/she may not make any purchases.
15. Children are admitted to the FOOD & NON FOOD Departments, on the understanding that they are kept under strict parental control. Animals cannot be admitted inside MAKRO, guide dogs excepted. SMOKING is not permitted.
16. Subject to the MAKRO guarantee, terms of which are available from MAKRO stores, all warranties and conditions, express or implied, including, but not limited to, implied warranties or conditions of satisfactory quality, merchantability and fitness for a particular purpose relating to MAKRO’s sales of products are excluded to the extent permissable by law.
17. The conditions of use are binding on each and every user. The Holder is bound by and liable for any act or omission on the part of any authorised user, Such act or omission includes any commited by a person or persons accompanying any authorised user when using the Tradecard or when otherwise on the premises of MAKRO. The Holder shall be liable to MAKRO for any loss, including but not limited to consequential loss and loss of reputation, caused to it by any such breach of the Conditions of Use.
By accepting the Conditions of Use, the Holder agrees that it shall indemnify MAKRO in respect of any liability, loss and damage, including but not limited to consequential loss, suffered by any third party and claimed from MAKRO as a consequence of any breach by the Holder or any of its authorised users
of the Conditions of Use.
18. Title to goods on an invoice shall not pass to the Holder until full payment has been received by MAKRO.
19. Collection, Use, and/or Processing of Data:
19.1 MAKRO will collect, process, and/or use the information provided by the Holder (”Personal Data”) for the purposes of administering and performing the customer contract with MAKRO, general and long-term customer care and personalised customer service, as well as sales promotion, market and opinion research activities (by mail and electronic communications).
19.2 As MAKRO is part of the METRO-Group, a large group of companies operating internationally, Personal Data may be transferred to and back from one of the International Data Centres of the METRO-Group (operated by the METRO-Group Information Technology GmbH (MGI), “Data Centres”) and may be processed in the Data Centres to achieve the purposes identified in 19.1. MAKRO and the Data Centres operate in compliance with European data protection rules to provide for a coherent level of adequate data protection even in those cases where data are transferred to countries with a different level of data protection.
19.3 Access to Personal Data will be limited to authorised employees as required for the purposes identified in 19.1 as well as IT security and maintenance. MAKRO uses reasonable technical and organisational measures to protect the security and confidentiality of Personal Data and regulary reviews and improves these measures as necessary to reflect legal developments and/or improvements in available technology.
19.4 Authorised users have the right to access and review their Personal Data and to request that their Personal Data be corrected, amended, deleted, or blocked.
19.5 An authorised user may withdraw their consent at any time.
19.6 Any further questions and/or a wish to (i) access or review Personal Data, (ii) make a request related to Personal Data or (iii) withdraw consent provided hereunder, should be directed to the MAKRO Data Protection Compliance Officer at Liverpool Road, Barton Moss, Eccles, M30 7RT.
20.1 Anyone purchasing a business to business electrical or electronic equipment product (as defined in the Waste Electrical and Electronic Equipment regulations 2006, the “regulations”) (”product”) from MAKRO shall be responsible for the costs of collection, treatment, recovery and environmentally sound disposal of the product and any product that the product is intended to replace (”Replaced Product”) in accordance with the regulations.
20.2 Anyone purchasing a product from MAKRO shall not dispose of a Product or Replaced Product other than in accordance with the Regulations.
20.3 Anyone purchasing a Product from MAKRO agrees to indemnify and keep indemnified MAKRO from and against any and all loss damage or liability suffered and legal fees and costs incurred by MAKRO resulting from a breach of this clause.
21. If MAKRO intends to change the Conditions of Use, MAKRO will inform the Holder. If the Holder continues to use the Tradecard or does not object to such change within a period of two weeks after receipt of notice, the change will be deemed accepted.
 
Store Access - All stores comply with DDA requirements. If you require assistance please ask a member of staff. Please note that prams and pushchairs are not permitted in stores for health and safety reasons. Bags above a certain size are also not permitted (see in store for details). MAKRO reserves the right to check customer purchases at end control.
