Customer Ordering Terms & Conditions

General: To place an order for collection by YOU from Makro YOU must be a registered with MAKRO and hold a valid MAKRO tradecard. This service is provided by Makro Self Service Wholesalers Limited ("MAKRO"). In accordance with MAKRO’s terms and conditions of membership (see Makro Tradecard Terms & Conditions for further details) by placing an order YOU confirm that you operate as a business and that YOU are 18 years of age or over. As you are purchasing as a business, the provisions of the Consumer Protection (Distance Selling) Regulations 2000 shall not apply.

1. Purchase Contract: All orders for collection from MAKRO (“Collection Orders”) are governed by these Terms which may from time to time be varied by MAKRO. If YOU place a Collection Order after we have published any changes you will be bound by those changes. Accordingly, you should check prior to each order to ensure that you understand the terms relevant to your purchase.

MAKRO’s acceptance of your order and creation of a binding contract between YOU and MAKRO will take place upon MAKRO’s confirmation to YOU of its acceptance of YOUR Collection Order by email, fax or telephone depending on the medium by which YOU have placed YOUR Collection Order.

When the contract is made YOU agree that YOU will pay the price for the Collection Order and MAKRO will make available for collection the goods in the Collection Order  pursuant to these Terms.

2. Pricing and Availability: Prices are as per MAKRO’s current published Collection Order price list or otherwise as indicated in the MAKRO home store for the MAKRO tradecard holder placing the Collection Order. All price indications exclude VAT which will be zero rated or standard rated as indicated on the relevant product shelf edge ticket. Where applicable VAT will be charged on purchases and indicated on the invoice.

MAKRO reserves the right to change prices without prior notice. Any price indications are for guidance only and are subject to availability. The Collection Order value cannot be calculated until the day of actual collection as prices of some products will fluctuate in line with market prices in YOUR MAKRO store on the day your order is picked and collected.

On some special offers there may be a limit on the quantities of goods that can be supplied to each customer.

3. Collection: The  collection dates and times will be as set out on the Collection Order form overleaf. There shall be no liability on MAKRO for late availability of orders for collection.  Makro will try to get in contact with YOU if the Collection Order will not be available on time. YOU will attend the MAKRO store to collect the Collection Order at the time and date on the Collection Order.

Any Collection Orders not  collected at the time and date on the Collection Order due to no fault of MAKRO, will remain the property of MAKRO and MAKRO shall be entitled to charge YOU the full price of the Collection Order as the products will have been specially ordered to meet your Collection Order.

4. Limitation: Other than as set out in these Terms, MAKRO’s maximum liability arising out of any order for the supply of goods to YOU under this contract will be limited to the price of the goods contained in that order.

5. Force Majeure: MAKRO will not be deemed to be in breach of contract or of these Terms as a result of any delay in performance or failure to perform its obligations if that delay or failure to perform is due to any cause or circumstance beyond MAKRO’s reasonable control including, but not limited to, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war, breakdown of equipment or road traffic problems.
